Probate Administration
Probate and estate administration is the legal process of managing and distributing a deceased person’s assets and debts after their death, ensuring that the deceased’s wishes are honored, and that their estate is settled according to the law and the terms of the will (or laws of intestacy if there is no will).
Probate administration may include:
- Identifying assets and liabilities
- Paying debts and taxes
- Preparing and filing all probate documents
- Publishing notice to creditors
- Preparation of estate accountings
- Planning how and when to make distributions to beneficiaries
- Funding trusts
- Coordinating with CPAs to file final individual income tax return
- Coordinating with CPAS to prepare fiduciary income tax returns
- Guardianship proceedings for assets left to minors
- Ultimately distributing remaining assets to beneficiaries
